KENYA SENTENCES PIRATES FOR TAKING GERMAN SHIP

(Reuters) - A Kenyan court in the coastal city of Mombasa sentenced nine Somalis on Tuesday to five years in prison each for attempting to hijack the German merchant vessel MV Courier in the Gulf of Aden in March 2009. EDITORS NOTE: The pirates convicted in this story were Somalis captured by international naval forces and tried in Kenya. Somalia as a failed state is considered an incompetent jurisdiction. The World is fortunate that Kenya with a respected court system has been willing to handle so many of these cases. These men were the traditional assailing bandit type pirates we wrote about recently. They forced their way aboard the ship with fire arms, put the entire crew in fear of their lives and did it strictly for personal gain. However they in fact did not kill anyone. The five year sentence combined with their protracted pretrial confinement is in line with most western nation first offender sentencing guidelines for armed robbery. The appropriate reservation of maximum sentencing for piracy to those cases involveing murder (death or life in prison depending on jurisdiction) makes sense in providing an incentive to pirates to avoid harming their captives. Kenya having accepted jurisdiction for this international crime now incurs not only the costs of trial but also incarceration. The world owes Kenya a debt for its extraordinary role in combating piracy through offering navies an alternative to catch and release. However we feel every flag state that directly benefits by this convenience should be obligated to pay court costs and incarceration costs. So in this case involving a German ship, Germany should reimburse Kenya and assume the responsibility of attempting to obtain restitution from the captives (good luck on that one). Kenya has earned a place of dignity in the community of nations. If no one else says it.....Thank you Kenya.

RUSSIA SUPPLYING VIETNAM WITH HIGH TECH SUBMARINES

RUSSIA PROVIDING "BLACK HOLE" SUBMARINES TO VIETNAM, WHICH IN TURN IS BEEFING UP ITS NAVAL FORCES TO DEFEND THEIR ISLANDS FROM CHINA:

  China seems to fail to notice that it has no friends or real allies. They close ranks now and then with Russia but Russia is hardly a friend. Knowing full well that China intends to forcefully occupy the "first island string" all the way to the beaches of Vietnam and the Philippines Russia has chosen to sell high tech submarines to Vietnam which is defending its coastal islands from Chinese aggression. As noted in Defense World recently:

  "Russia is expected to deliver the first Varshavyanka class of the six submarines to Vietnam in November, officials announced today.
The Varshavyanka class (Project 636M) of diesel-electric submarines, dubbed by the U.S. Navy as “black holes in the ocean”, has very low noise emission and can hit targets at long distances without being detected by an enemy’s anti-submarine warfare assets.
While the Vietnamese crew has been undergoing training since April, the submarine successfully completed 100-day sea trials in July this year, Admiralty Shipyards officials stated.
Vietnam ordered a fleet of six Russian-made submarines in 2009, seen as an effort to counterbalance China’s expanding maritime influence in the region."

This isn't just a sale of hardware but an outfitting and training program as well. The submarine is the traditional naval weapon of the underdog, a great equalizer against a powerful surface fleet. With this equipment from Russia Vietnam has a fighting chance at making the dragon pay for his folly. One would think that the Dragon would learn, continued aggressive naval behavior will eventually lead to a naval war, with the Dragon suddenly finding itself alone in the world and discovering that the Philippines, Vietnam, and Japan combined are far more formidable than they first appear and far from friendless. Once the shooting starts China can not count on anyone but the insane and ineffective leader of North Korea to come to their aid, and maybe not even him, there is always the possibility that he is not that crazy.

AN EXPANDED DEFINITION OF PIRACY, NOT REALLY A GOOD IDEA

EDITOR'S NOTE: The captioned photo above and the quote below are from an article in g captain that describes recent developments among non state maritime organizations and recent expanded rulings by U.S. Courts on piracy. American Admiralty Information Systems believes these new developments are harmful to the international order on the high seas. Increasingly violent and dangerous actions by organizations like SeaShepherd and Green Peace endanger ships, seamen and the environment. Legally labeling these NGOs as "Pirates" diminishes public support for harsh penalties against traditional pirates, as "assailing bandits". NGOs that violate the peace without the willful intent to sink vessels or harm people and who do cause physical damage should be treated as some sort of "marine vandal" subjecting the ship to seizure, and the crew to such penalties as are prescribed under the flag state of the nation that credentialed them as seamen for reckless and negligent operation. If any one is killed or injured the deck officers on watch at the time of the action should be tried for voluntary manslaughter, and the rest of the crew as accessories. Owning organizations and the crews should be always held to civil liability for their acts. 
  
 Some of us here have actually had to deal with Green Peace protestors who endangered safe tanker passage through a narrows. How causing an oil spill by harassing a tanker is supposed to help the environment we don't know. But being buzzed by small craft, or having acid or excrement thrown up on your decks, or fouling  a prop in a booby trap laid by one of their vessels just isn't on the same order of danger as being boarded by the traditional assailing bandit type pirate with their direct intent of fully gaining control of your ship and total willingness to use a gun on your crew. The seriously misguided and over the top activists of these marine conservation NGOs just aren't that threatening, despite the fact that their acts are inherently dangerous. They must be held accountable for their acts for what they are vandalism, malicious misconduct, and potentially but so far not yet voluntary manslaughter. Lest you think we've gone soft on "pirates" keep in mind that we have always advocated the "Captain Woods Rogers Solution" for traditional pirates. That solution is to return jurisdiction over pirates directly to the World's Navies to combat, capture, try, and punish pirates , if necessary by drum head courts held on the fantail or quarter deck. That solution worked in the past. Elimination of that solution has resulted in the ineffective "catch and release" programs as the world's navies are forced into trying to find a nation state willing to prosecute captured pirates and witnesses, once all neatly aboard the warship scatter to the far corners of the globe. Keep the NGO delinquents out of the piracy class of unrepentant miscreants. We urge you to read the  gcaptain article that we link you to below and consider our opinion, the opinion of experienced mariners and admiralty litigators.

The last decade has again reminded us that irregular warfare can be every bit as challenging and deadly as conventional wars, even in the maritime setting.  Al-Qaeda in the Arabian Peninsula (AQAP), Somali pirates, and Lebanese Hezbollah have demonstrated at least some capability to challenge the primacy of modern navies at sea.  Maritime non-state actors wreaking havoc on the ocean are nothing new.  Pirates in particular have menaced merchants and navies around the world for hundreds of years.  But the advent of transnational terror groups with IEDs or modern anti-ship missiles capable of destroying a warship is fairly recent.  The evolution of these non-state actors at sea challenges the conventional definitions of a naval force."

The Military Version of the CoralBot

World’s first fleet of marine drones being tested in the Mediterranean

"An odd underwater ballet has been unfolding in the Mediterranean port of Toulon these past few days.
Under the scrutiny of their masters, whose eyes are glued to computer screens, the world’s first fleet of “marine drones” is being put through its paces.
Five European countries — France, Germany, Italy, Spain and Portugal — have sent prototypes here under a four-year, four-million-euro ($5.32-million) programme to build a squad of unmanned underwater rovers. Deployed from a surface vessel, but communicating among themselves and using artificial intelligence, the wireless scouts would spread out in a surveillance network."

 Shades of the CoralBot, we think this news underscores what we have been trying to tell the public about the CoralBot. The European military is already operating parts of the key technology but if you look at the pictures of the military version at the linked in Agence France Presse site you will note the decided lack of arms. These military diving bots won't be fixing coral reefs and don't look for any military funding for the CoralBot. The artificial intelligence technology is there, the swarm intelligence and communications technology is already well developed. The CoralBot is all about a different configuration. But it costs money and money is not flowing to conservation efforts right now, unless it comes voluntarily directly from the public. There is little government or industrial interest in fixing coral reefs.

We had more news than our small staff could reasonably deal with near the end of last week, over the week end, and into Monday concerning events in the China Seas and the Dragon's continuing aggressive pursuit of territory that belongs to its neighbors. In a nut shell China continues on its aggressive path and its neighbors are beefing up their naval defenses and calling in U.S. Markers. As usual the mainstream media doesn't seem to deem the news worthy of the editorial cut for the evening television news or front pages, though regional affiliates of large news organizations like AP do carry the stories.
