PROSECUTOR CHARGES SHIP OWNER OF COCAINE LOADED BULGARIAN SHIP

Editorial Note: 3/16/2016  This was one of the first cases we reported on in recent times where a court had reached beyond the ship's master to impose potential criminal liability on ownership or management when a ship was misused. Since then we have several times reported on American courts, or the Coast Guard, utilizing the "Seaman's Manslaughter Statute" to impose criminal liability on ownership or management in cases of fatal accident. Indeed we have reported on a visible trend in admiralty tribunals in recent years to criminalize marine accidents generally and stated our belief that this may be a bit over done and a contributing factor in the global shortage of professional mariners.  A Bulgarian special anti mafia prosecutor's office has taken the unusual action of arresting the individual with the controlling interest in a shipping company. The company owns a ship discovered smuggling cocaine into Spain from Latin America . The owner charged is Doychin Doycheu owner of Seaborne Trade Company which in turn owns the ship SV NIKOLAY . The ship was recently arrested along with a number of Bulgarian crew members when caught smuggling cocaine into Spain.  Doycheu was charged by the Bulgarian prosecutor with "participation in an organized crime group."
